More on EPA's New Rule on Definition of Solid Waste

US EPA estimates that about 5,000 facilities will be impacted by the Agency's final rule, which among other things establishes four mandatory legitimacy crtieria.  The goal of this final rule is to allow eligible spent materials to qualify for exemptions under hazardous waste regulations. Adoption of the legitimacy criteria grants US EPA a greater, up front role in verifiying the legitimacy of third party recyclers.  Companies and recyclers will need to demonstrate the following mandatory critieria:
  • makes a useful contribution to the recycling process
  • produces a valuable product
  • is managed as a valuable commodity
  • is comparable to a legitmate product
As this final rule is considered a deregulatory action, states will be required to adopt their own rules and regulations to take advantage of this final rule.  SGIA will keep the industry updated as this rule moves forward.

Legislation in New Jersey Will Ban Black Printing Ink

In the start of a growing trend focusing on banning carbon black and other “toxic” chemicals, legislation was introduced in the New Jersey Senate on April 15, 2024, that would ban the use of carbon black and other toxic chemicals in packaging. The bill, S3135, Toxic Packaging Reduction Act, would require producers of packaging to reduce the amount of packaging being produced and calls for the creation of a Toxic Packaging Task Force.

Two Bipartisan Bills Advancing Recycling Pass the Senate

The U.S. Senate unanimously approved the Recycling Infrastructure and Accessibility Act (S. 1189) and the Recycling and Composting Accountability Act (S. 1194), which will help build recycling and composting infrastructure projects, increase data collection, and explore a national composting strategy. The two bipartisan bills would help the U.S. reach its national recycling goal of 50 percent by 2030.
