Dan Barefoot Named VP Global Sales and Marketing of Prism Inks

Prism Inks, Inc., based in Sunnyvale, California is pleased to announce Dan Barefoot’s promotion to Vice President of Global Sales and Marketing of Prism Inks. Barefoot will be responsible for working with the Prism Inks management team in enhancing their distribution channel, new marketing initiatives and driving the developmentof new opportunities for Prism. Barefoot joins the Prism team through their acquisition of Graphics One in 2017, where he will continue to be involved in the day-to-day management. Barefoot founded Graphics One in 2000 and prior to that held business development and marketing management positions at Lockheed Martin and CalComp/BII. According to Amir Ajanee, CEO Prism Inks, “Dan and I have worked together since the founding of our mutual companies. Prism Inks has been expanding at an explosive rate and welcomes the addition of Dan to help us continue to execute our aggressive plans over the years to come. We are both excited about the opportunity of working together.”

Federal Trade Commission Bans Non-Competition Agreements

On April 23, 2024, the Federal Trade Commission (FTC) banned companies from using non-competition agreements – generally referred to as “noncompetes” in employment agreements, severance agreements, and other contracts. The purpose of noncompetes is to protect employers from being competitively disadvantaged by companies that hire their employees away from them and then benefit from that former employee’s inside knowledge of the company, which theoretically provides an unfair advantage to the hiring company.

New Department of Labor Independent Contractor Rule Now in Effect

A new Department of Labor (DOL) Independent Contractor (IC) Rule went into effect on March 11, 2024. The new IC Standard is now the guide to determine whether a worker is an employee of a company or is self-employed and therefore “independent” from the company. If the worker is independent, then the relationship with the company is governed by the contract for services and the worker does not have the benefits or protections that attach to being an employee.

The New Joint Employment Standard is On Hold Indefinitely

On Friday, March 8, 2024, a Texas federal court struck down the newest version of the Joint Employer Standard that the National Labor Relations Board (NLRB) revised in October 2023. The new standard was to go into effect on Monday, March 11, 2024. The Texas court’s ruling has blocked implementation of the new standard, which means the existing standard will continue to be in effect.
