Nevada Governor Updates COVID-19 Enforcement Guidance

Governor Steve Sisolak has issued updated guidance regarding Nevada OSHA’s enforcement process during the COVID-19 pandemic.  This guidance is effective immediately and impacts all businesses operating in the state, including printing operations. 

In counties where the infection rate is increasing, Nevada OSHA will step up its enforcement efforts and make unannounced visits to businesses to observe compliance with posting of signs, use of face coverings, social distancing, and sanitation requirements.  If violations are noted, NV OSHA will open an investigation with the employer, which may lead to a citation. If a citation is issued, a notice will be provided with the citation indicating that in the event of future noncompliance, a cease work order may be issued to the business until proper operating procedures have been implemented.  If a business was cited, it will receive another visit from Nevada OSHA to determine if the violations have been corrected.

For counties that are not experiencing an increased infection rate, a three-step process will be undertaken.  First, unannounced visits may be made to ensure compliance with all requirements as previously stated above.  If violations are noted, then a notice will be provided to the business reminding the company of the requirements, and that failure to comply could result in a citation. 

Nevada OSHA will continue to conduct follow up visits to companies where notices have been issued.  If continued noncompliance is noted, then a citation will be issued.  It is possible that the business could be ordered to cease operations until proper operating procedures have been implemented.

For businesses cited during this follow up visit, Nevada OSHA will visit again to ensure that all violations were corrected.  If not, then an order to cease operations may be issued until all are corrected.
